Article 1: Applicability of These General Terms and Conditions of Sale
These general terms and conditions of sale apply to the online store audiolithefx.com, as well as to any orders placed directly with AUDIOLITHE. They are effective as of April 24, 2024.
Article 2: Acceptance of These General Terms and Conditions of Sale
Any order placed on the online store audiolithefx.com, or directly with AUDIOLITHE, constitutes full and unconditional acceptance of these general terms and conditions of sale.
Article 3: Pricing
The prices of our products delivered within France and Europe are listed in euros, inclusive of all taxes, excluding handling and shipping fees.
The prices of our products delivered outside Europe are listed in euros, exclusive of taxes and handling/shipping fees. Payment of applicable VAT and customs duties is the responsibility of the customer and must be made to local tax and customs authorities.
Article 4: Availability
Our product and price offers are valid as long as they are visible on the website and subject to stock availability. Information regarding the availability and shipping times of items is provided for informational purposes only and does not constitute a contractual commitment.
Article 5: Shipping and Delivery
5.1 Address Verification
Customers are responsible for verifying the accuracy of the information they provide on the website. AUDIOLITHE cannot be held liable for incorrect or incomplete addresses. Any costs for re-shipping due to delivery errors caused by the customer will be borne by the customer.
5.2 Delivery Timeframes
Our delivery times are indicative only and maintained to the extent possible. They do not constitute a binding commitment. Any delays do not entitle the buyer to cancel the sale, refuse the merchandise, or claim compensation.
5.3 Receipt of Delivery
It is the customer’s responsibility to inspect the condition of the packages upon delivery, as well as the number of packages delivered. In case of visible packaging issues, the customer must notify the carrier. If legal reservations are not made, AUDIOLITHE cannot be held liable for any issues with the ordered products.
Article 6: Payment
For individuals, payment must be made in advance by credit card or PayPal. For businesses, payment methods include credit card or bank transfer. Payment is required at the time of order placement. Unless otherwise stated, all invoices issued by AUDIOLITHE must be paid before the merchandise is shipped.
By Credit Card:
Credit card users commit to ensuring they have the necessary authorization to use the card and guarantee this to AUDIOLITHE.
Article 7: Retention of Ownership Clause
In accordance with French law 80-335 of May 12, 1980, goods remain the property of AUDIOLITHE until full payment of invoices, including in cases of bankruptcy or liquidation. In the event of non-payment by the agreed deadlines, after failed settlement attempts and 15 days following receipt of a registered letter, AUDIOLITHE reserves the right to cancel the sale and request the return of goods. Returned goods will be inspected, and in cases of damage or wear, depreciation may be applied.
Article 8: Withdrawal
Under Article L121-18 of the French Consumer Code, for orders placed on audiolithefx.com, customers have a 14-day withdrawal period from the date of delivery to return products to AUDIOLITHE (22 Rue Saulnier, 75009 Paris) for exchange or refund, excluding return shipping costs borne by the customer. AUDIOLITHE extends this period to 30 days under the following conditions:
• Items must be in perfect condition, with all accessories included, and in their original, like-new packaging.
• Customers must notify AUDIOLITHE of the return reason and request a return number via email at contact@audiolithefx.com.
• The return number must be visibly displayed on the package to identify it.
Failure to meet these conditions may result in deductions for wear or rejection of the refund.
Article 9: Warranty
Products are warranted for life from the date of purchase. Warranty claims must be pre-approved by contacting contact@audiolithefx.com to obtain a return number, which must be displayed on the package.
Exclusions from the Warranty:
• Improper or non-compliant use of the product
• Normal wear and tear
• Surface coating damage
• Modified products
• Repairs by unauthorized service providers
Article 10: Legal Notices and Liability
In accordance with French law “Informatique et Libertés” No. 78-17 of January 6, 1978, customers have the right to access and correct their data by sending a request to: AUDIOLITHE, 22 Rue Saulnier, 75009 Paris.
Article 11: Jurisdiction
This contract is governed by French law. In the event of a dispute, only the courts of Paris will have jurisdiction.
