GENERAL CONDITIONS OF SALE

Article 1: Applicability of these general conditions of sale

These general conditions of sale apply to the online sales site audiolithefx.com, as well as to any order placed directly with AUDIOLITHE. They apply from April 24, 2024.

Article 2: Acceptance of these general conditions of sale

Any order placed on the online sales site audiolithefx.com, or directly with AUDIOLITHE, commits the customer to full and unconditional acceptance of these general conditions of sale.

Article 3: Prices

The prices of our products delivered in France and Europe are indicated in euros all taxes included, excluding participation in processing and shipping costs.
The prices of our products delivered outside Europe are indicated in euros excluding taxes, excluding participation in processing and shipping costs. The payment of the applicable VAT, as well as customs duties, is the responsibility of the customer to the local tax and customs authorities.

Article 4: Availability

Our product and price offers are valid as long as they are visible on the website, within the limits of available stocks. Information on availability and shipping times for items is provided for informational purposes only and does not constitute a contractual commitment.

Article 5: Shipping and delivery

5.1 It is the responsibility of the customer to verify the information provided on the website. AUDIOLITHE cannot be held responsible for incorrectly entered addresses or missing information. The customer is responsible for any defects in information and will be responsible for any re-shipment of a product in the event of a delivery error.

5.2 Delivery time
Our delivery times are given for information only and are maintained to the best of our ability. Under no circumstances do they constitute a formal commitment. Any delays do not entitle the buyer to cancel the sale, refuse the goods, or claim damages.

5.3 Order receipt
It is the responsibility of the customer to check or have checked the condition of the parcels upon delivery, as well as the number of parcels delivered. In the event of an apparent anomaly in the packaging, it is the customer's responsibility to make reservations with the carrier. In case of a problem, if the legal reservations have not been made, AUDIOLITHE cannot be held responsible for any problem with the ordered product(s).

Article 6: Payment

For individuals, payment for your purchases is made in advance by credit card or PayPal. For professionals, the following payment methods are accepted: credit card, bank transfer. Payment is made at the time of order. Unless otherwise stated, any invoice issued by AUDIOLITHE must be paid by the customer before shipment of the goods.

By Credit Card:
The user of credit cards undertakes and guarantees to AUDIOLITHE that he/she has all the authorizations required to use said cards.

Article 7: Retention of title clause

In accordance with Law No. 80-335 of May 12, 1980, the goods remain the property of AUDIOLITHE until full payment of the invoices, including in the event of receivership or judicial liquidation. In the event of non-payment on the agreed due dates, after failed replacement proposals and 15 days after acknowledgment of receipt of a registered letter, AUDIOLITHE may consider the sale as automatically terminated, and may demand the return of the goods. In the event of judicial liquidation, the goods still in the possession of the buyer are presumed to be those still unpaid and may be taken back in compensation for the unpaid invoices. In this case, the returned goods will be subject to careful examination, and in the event of damage or wear and tear (equipment used for demonstration), a discount will be calculated and applied, which will be deducted from the credit note granted.

Article 8: Withdrawal

Under Article L121-18 of the Consumer Code, for any order placed on the website audiolithefx.com, the customer has a period of 14 clear days from the delivery of his/her order to return products to AUDIOLITHE at 22 RUE SAULNIER 75009 PARIS, for exchange or refund, without penalties except for the return costs borne by the buyer. AUDIOLITHE nevertheless extends this period to 30 days subject to the following conditions:

The equipment must be in perfect condition, accessories returned, original packaging in new condition. The customer must first inform AUDIOLITHE of the reason for the return and request a return number by email at contact@audiolithefx.com. The return number must be clearly indicated on the package in order to identify it. Failing to comply with the conditions stated above, the refund will be reduced by a wear and tear allowance established on a case-by-case basis, or even refused.

Article 9: Warranty

The equipment is guaranteed for life from the date of invoicing, return to our workshops or to a technical station of our choice, with the shipping costs remaining at your expense. Any warranty return must first be the subject of a return number request by email to contact@audiolithefx.com. The return number must be clearly indicated on the package in order to identify it.

The following are excluded from the warranty:

- abnormal or non-compliant use of the products.

- normal wear and tear

- damage to surface coatings

- products that have been modified

- products that have been repaired by any technical service not approved by AUDIOLITHE

Article 10: Legal notices and liability

In accordance with French Law "Informatique et libertés" No. 78-17 of January 6, 1978, you have the right to access and rectify data concerning you, which you can exercise by sending a letter to the following address: AUDIOLITHE, 22 RUE SAULNIER 75009 PARIS

Article 11: Jurisdiction

This contract is governed by French law. In the event of a dispute or challenge, only the Courts of Paris shall have jurisdiction.
